This Privacy Policy describes how Trackwise LLC ("Trackwise", "we", "us") collects, uses, discloses, and safeguards personal information when you visit trackwise.finance, use our platform, or communicate with us. 2. Information we collect
- Identity: name, date of birth, government identifiers, photos of identity documents, and beneficial-owner information for businesses.
- Contact: email, phone number, mailing address.
- Financial: bank account details, card metadata, transaction history, and tax identifiers where required by law.
- Device and usage: IP address, user agent, device identifiers, pages viewed, links clicked.
- Communications: messages you send us, support tickets, recorded calls where you have been notified.

3. How we use information
- To open and operate accounts and provide platform services.
- To comply with the Bank Secrecy Act (BSA), USA PATRIOT Act, OFAC sanctions, and other applicable laws.
- To verify identity (KYC), business identity (KYB), and beneficial ownership.
- To screen against sanctions lists (OFAC, UN, EU, UK HMT, country-specific lists) and politically exposed person (PEP) lists.
- To detect and prevent fraud, money laundering, and other financial crime.
- To respond to inquiries and provide support.
- To comply with lawful requests from regulators, courts, and law enforcement.
4. Mobile information and SMS
If you opt in to SMS, Trackwise sends messages strictly for account
verification (OTP), login confirmation, transactional alerts, and fraud
notifications. Message frequency varies. Message and data rates may apply.

Trackwise does not share, sell, rent, or otherwise transfer SMS opt-in data or consent to third parties for marketing. SMS-related information is shared only with our messaging provider (Twilio Inc. or a successor carrier) strictly to deliver the requested messages, and with regulators or law enforcement where required by law. 5. Legal bases
- Contract: to provide the services you request.
- Legal obligation: BSA / AML, sanctions, tax reporting.
- Legitimate interest: fraud prevention, platform security, service improvement.
- Consent: for SMS, marketing emails, and certain cookies.
6. Sharing
We share personal information with:
- Licensed banking and card-network partners that provide the underlying financial services.
- KYC, KYB, sanctions screening, and fraud-prevention vendors.
- Cloud hosting, observability, and security vendors operating on our behalf under contract.
- Regulators, courts, and law enforcement where required by law.
- Successors in a merger, acquisition, or reorganization, subject to this Policy.
We do not sell personal information.
7. International transfers
Trackwise is based in the United States. Personal information of customers outside the U.S. may be transferred to and processed in the U.S. Where required, we rely on Standard Contractual Clauses (SCCs) or other lawful transfer mechanisms.
8. Retention
We retain identity, transaction, and communications records for at least five (5) years after the end of the customer relationship, as required by 31 CFR Chapter X (BSA recordkeeping). Some records are retained longer when required by law.
9. Your rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you.
- Correct inaccurate information.
- Delete information, subject to our retention obligations.
- Port a copy of your data.
- Object to processing or withdraw consent.
- Lodge a complaint with a supervisory authority — e.g., ICO (UK), AEPD (Spain), ANPD (Brazil), INAI (Mexico), SIC (Colombia).

10. California Consumer Privacy Act (CCPA / CPRA)
California residents have the right to know, delete, correct, and opt out of "sale" or "sharing" of personal information. We do not sell or share personal information in the CCPA sense.
11. Children
Our services are not directed to children under 18. We do not knowingly collect personal information from children.
12. Security
We protect personal information with administrative, physical, and technical safeguards including TLS 1.2+ in transit, AES-256 at rest, least-privilege access, MFA, secrets management, vendor risk reviews, and routine internal audit. See our Security overview.

We may update this Policy from time to time. The "Last updated" date above indicates the latest revision. Material changes will be communicated to account holders.
